📋 Terms of Service

Please read these Terms of Service carefully before joining eBooks Galore. By registering and paying your membership fee, you agree to be bound by these terms. These terms comply with the Consumer Protection Act No. 68 of 2008 and the Electronic Communications and Transactions Act No. 25 of 2002 (ECTA).

1. About eBooks Galore

eBooks Galore is a digital membership platform operated by Yourway.co.za, South Africa. Members pay a once-off joining fee and a monthly subscription to access a library of digital eBooks and to participate in a referral commission programme.

2. Membership & Fees

2.1 Joining Fee

A once-off joining fee of R300 is required to activate your membership and gain immediate access to the eBook library and referral programme.

2.2 Monthly Subscription

A monthly fee of R200 is required to maintain active membership status and continued access to the eBook library and commission programme. Failure to pay the monthly fee may result in suspended commission earnings.

2.3 Fee Changes

We reserve the right to adjust membership fees with at least 30 days' written notice to existing members via email.

2.4 Payment

All payments are processed securely through Yoco. We do not store your card details. You may also pay via EFT as arranged with the administrator.

3. The Referral Commission Programme

Important: eBooks Galore is a legitimate membership programme that provides real value through digital eBook access. It is NOT a pyramid scheme. The Consumer Protection Act No. 68 of 2008 prohibits pyramid schemes. Our programme pays commissions for referring paying members who receive a real digital product — not merely for recruitment.

3.3.1 Voluntary participation

Participation in the referral commission programme is entirely voluntary. You are under no obligation to refer anyone. You may enjoy full eBook library access without ever referring another member.

3.3.2 Independent contractor relationship

If you choose to refer new members and earn commissions, you do so as an independent contractor and not as an employee of eBooks Galore. This means:

This relationship is governed by South African common law as a contract for services, and not by the Labour Relations Act 66 of 1995 or the Basic Conditions of Employment Act 75 of 1997. Accordingly, you are not entitled to employment benefits including but not limited to leave pay, sick leave, pension, medical aid contributions, overtime pay or notice pay.

3.3.3 Tax obligations — your responsibility

As an independent contractor, you are solely responsible for your own tax affairs. eBooks Galore does not:

SARS compliance is your legal obligation. Failure to declare commission income to SARS may constitute a criminal offence under the Tax Administration Act 28 of 2011. eBooks Galore strongly recommends that you consult a registered tax practitioner or accountant regarding your individual tax obligations. You can also visit www.sars.gov.za or call SARS on 0800 00 SARS (7277).

3.3.4 eBooks Galore reporting obligations

eBooks Galore reserves the right to report commission payments made to members to SARS as required by applicable tax legislation. We may request your income tax reference number for record-keeping purposes. We will issue you with a commission statement on request showing total commissions paid during any financial year.

Past earnings or projections shown in our calculator are illustrative only. We make no guarantee of any specific income. Your earnings depend entirely on the activity of paying members in your network. Many members earn little or nothing from the referral programme.

5. Cancellation & Cooling-Off Period

5.1 Cooling-Off Right (CPA Section 16)

In accordance with the Consumer Protection Act, you have a 5 business day cooling-off period from the date of joining to cancel your membership and receive a full refund, provided you have not downloaded any eBooks.

5.2 Monthly Subscription Cancellation

You may cancel your monthly subscription at any time. Cancellation takes effect at the end of the current paid period. No partial refunds are issued for unused portions of a paid month.

All eBooks in our library are licensed for member access only. Copyright remains with the respective authors and publishers. eBooks Galore website content, design and software are proprietary to Yourway.co.za.

9. Limitation of Liability

To the maximum extent permitted by South African law, eBooks Galore shall not be liable for any indirect, incidental or consequential damages arising from your use of our platform. Our total liability to you shall not exceed the fees you have paid in the 3 months preceding any claim.

10. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved first through good-faith negotiation. If unresolved, disputes may be referred to the Consumer Goods and Services Ombud (CGSO) at www.cgso.org.za or the National Consumer Commission.

11. Changes to These Terms

We may update these Terms with at least 30 days' notice to existing members. Continued use of the service after the effective date constitutes acceptance of the updated terms.
